Legally Binding Agreement

These Terms and Conditions constitute a legally binding agreement between you and SecureCore regarding the use of our cybersecurity training services, website, and related educational materials. This agreement is governed by Japanese law and international regulations.

By enrolling in our courses, accessing our website, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must discontinue use of our services immediately.

2. Prohibited Activities and Legal Consequences

WARNING: The following activities may result in immediate service termination and potential legal action:

Unauthorized Network Access: Using learned techniques to gain unauthorized access to computer systems, networks, or data
Malicious Activities: Creating, distributing, or deploying malware, viruses, or other harmful software
Intellectual Property Violation: Unauthorized reproduction, distribution, or commercial use of course materials
Data Privacy Violations: Unauthorized collection, processing, or disclosure of personal data

3. Age Restrictions and Legal Capacity

Minimum Age Requirement: Users must be at least 18 years old or have reached the age of majority in their jurisdiction to enter into this binding agreement.

  • Valid government-issued identification may be required for verification
  • Corporate enrollments require authorized representative signatures
  • Academic institutions must provide proper authorization for student enrollments

4. Indemnification Obligations

You agree to indemnify, defend, and hold harmless SecureCore, its officers, employees, instructors, and affiliates from and against any claims, damages, losses, or expenses arising from:

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECURECORE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC COURSE OR SERVICE.

Direct Damages

Our liability for direct damages is limited to the fees paid for the affected service within the 12 months preceding the claim.

Indirect and Consequential Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or business opportunities.

Third-Party Claims

We are not responsible for damages arising from your interactions with third-party systems, networks, or software covered in our training.

7. Force Majeure Provisions

SecureCore shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including:

Natural Events

  • • Severe weather conditions
  • • Public health emergencies or pandemics
  • • Government-mandated closures or restrictions

Technical Events

  • • Internet service provider outages
  • • Cyber attacks or security incidents
  • • Third-party service failures
  • • Power outages or infrastructure failures

In such cases, we will make reasonable efforts to provide alternative delivery methods or schedule makeup sessions when possible.

Legal Information and Dispute Resolution

8. Governing Law and Jurisdiction

Applicable Law: These Terms and Conditions are governed by the laws of Japan, without regard to conflict of law principles.

9. Dispute Resolution Procedures

Informal Resolution

Contact our support team to resolve the issue through direct communication within 30 days of the dispute arising.

If informal resolution fails, disputes may be referred to mediation through the Japan Commercial Arbitration Association.

Legal Proceedings

As a last resort, disputes will be resolved through the Tokyo District Court system in accordance with Japanese civil procedure.

10. Severability Clause

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

Partial Invalidity: The invalidity of any single provision does not affect the validity of the remaining terms and conditions.

11. Terms Modification Policy

Modification Authority: SecureCore reserves the right to modify these terms at any time with 30 days' written notice
Notification Method: Changes will be communicated via email to registered users and posted on our website
Acceptance: Continued use of services after modification notice period constitutes acceptance of new terms

Additional Legal Provisions

12. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any course-specific agreements, constitute the entire agreement between you and SecureCore regarding the use of our services.

This agreement supersedes all prior negotiations, representations, or agreements relating to the subject matter herein.

13. Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. SecureCore's failure to enforce any right or provision shall not constitute a waiver of such right or provision.

14. Assignment

You may not assign or transfer these Terms and Conditions or your account to any third party without our prior written consent. SecureCore may assign this agreement without restriction.
